La atribución de ganancialidad y la aportación de bienes privativos a la sociedad de gananciales: repercusiones sobre el derecho de reembolso

Abstract

[ES]En este artículo se analiza la distinción legal entre bienes gananciales y privativos en una sociedad ganancial en el contexto de una ruptura matrimonial, así como de las reglas adicionales aplicables. En este sentido, los cónyuges pueden realizar pactos que permitan atribuir a un bien el carácter de ganancial, así como aportar bienes privativos a la sociedad de gananciales. Estas acciones pueden condicionar las soluciones a los futuros conflictos jurídicos vinculados a la liquidación de la sociedad de gananciales, y más concretamente las relacionadas con el ejercicio del derecho de reembolso en los casos donde uno de los cónyuges haya aportado dinero privativo para la adquisición de un bien ganancial o para hacer frente a las necesidades y cargas de la familia, y pretende recuperar lo invertido una vez se produce la ruptura matrimonial. En este sentido, ahondaremos en cómo el Tribunal Supremo ha sentado doctrina al respecto reconociendo los límites y las condiciones del ejercicio del derecho de reembolso ante las situaciones apuntadas.[EN] This article analyzes the legal distinction between community property and separate property in a community property partnership in the context of a marital breakdown, as well as the additional rules applicable. In addition, the spouses can make agreements allowing to attribute to an asset the character of community property, as well as to contribute a separate asset to the community of property. These actions can condition the solutions to the future legal conflicts linked to the liquidation of the community property, and more specifically those related to the exercise of the right of reimbursement in the cases where one of the spouses has contributed private money for the acquisition of a community property or to face the needs and burdens of the family, and intends to recover what was invested once the marital breakdown takes place. In this sense, we will deepen in how the Supreme Court has established doctrine in this respect recognizing the limits and the conditions of the exercise of the right of reimbursement in the above mentioned situations.
