La iniciativa legislativa popular en el ordenamiento jurídico español

Abstract

[ES] Superada la visión inicialmente desconfiada e intrascendente de la iniciativa legislativa popular, la institución ha recuperado relevancia en los últimos años de la mano de innovaciones legislativas en el ámbito autonómico y estatal; y un mayor empleo del mecanismo gracias a una concepción de la participación como índice de buen gobierno. El trabajo aborda la figura, en el capítulo primero, desde tres concepciones distintas aunque perfectamente compatibles: como instrumento de participación, como forma de ejercicio del derecho fundamental de participación, y como fase del procedimiento legislativo, sin perder de vista, en el capítulo segundo, la evolución jurídica de la institución a través de los debates parlamentarios. La obra se adentra, en los capítulos tercero y cuarto, en dos ámbitos que no habían acaparado hasta el momento suficiente interés, como son la regulación jurídica de la institución en las Comunidades Autónomas; y la práctica del instrumento a través del análisis de las iniciativas presentadas en el Congreso de los Diputados y las asambleas autonómicas. Los resultados indican que la iniciativa popular contribuye al pluralismo político permitiendo que la sociedad civil organizada plantee demandas escasamente atendidas por los poderes públicos, complementando nuestro necesario modelo representativo.
