Abstract

Este trabajo de investigación ha sido realizado en el marco de una Ayuda para la Formación de Profesorado Universitario (FPU) concedida por el Ministerio de Universidades del Gobierno de España como Personal Investigador en Formación Postdoctoral (POP) adscrita al Área de Derecho Procesal de la Universidad de Salamanca. Asimismo, este trabajo es parte de los Proyectos de Investigación “Cumplimiento normativo y protección penal de la Administración Pública” (PID2022-138775NB-I00) financiado por MCIN/AEI/10.13039/501100011033/ y por “FEDER Una manera de hacer Europa”, cuyo Investigador Principal es el Prof. Dr. Nicolás Rodríguez-García; y “Externalización de la investigación en el ámbito empresarial y efectos en el proceso penal” (PIC2-2023-03) de la Universidad de Salamanca, cuya Investigadora Principal es la Profª. Dra. Ana E. Carrillo del Teso.

[ES] El presente capítulo se centra en el análisis exhaustivo del procedimiento probatorio en el proceso penal español, respondiendo así al interrogante “¿cómo se prueba?”. En este sentido, se examinarán cuáles son los trámites procesales a través de los que se incorporan los medios de prueba legalmente previstos al proceso penal y que pueden sintetizarse en las siguientes fases: (i) proposición, (ii) admisión o, en su caso, denegación, y (iii) práctica, con las particularidades que existen en los supuestos en que tiene cabida lo que se conoce con el nombre de “prueba anticipada”.
