Abstract

[ES] El principio del "non bis in idem" en el ?mbito tributario juega un papel fundamental, dado que nuestro sistema presenta una dualidad entre el procedimiento sancionador tributario y el proceso penal ante un posible delito fiscal. Este principio supone tambi?n un derecho subjetivo, tanto en el ?mbito procedimental administrativo, como entre la convivencia entre las sanciones administrativas y las penas. Pero el desarrollo jurisprudencial del mismo presenta un tratamiento no arm?nico, especialmente entre el Tribunal Consitucional y el Tribunal Europeo de Derechos Humanos. El an?lisis de la dimensi?n material y de la dimensi?n adjetiva o procedimental del principio del "non bis in idem", centran el estudio, donde advertimos de los matices de concepto y de consecuencias entre los tribunales citados, que a nuestro juicio generan algunas fricciones que, en alg?n momento, habr? que resolver y que son las que centran la investigaci?n.
