Aporofobia y Derecho penal en el Estado Social

Abstract

[ES] El cap?tulo aborda como un acto delictivo que, en ciertos contextos de exclusi?n econ?mica, delito puede estar justificado por el estado de necesidad, o bien excluirse o atenuarse la responsabilidad. Examina c?mo el Derecho penal puede adaptarse para considerar la responsabilidad estatal en situaciones de pobreza extrema, justificando determinadas conductas en aras de la protecci?n de derechos fundamentales. Asimismo, se analiza la legitimidad de la punici?n en casos de miseria y exclusi?n, proponiendo una revisi?n del marco penal desde una perspectiva antiapor?foba y de justicia social.

El cap?tulo explora las implicaciones de la aporofobia desde una perspectiva pol?tico-criminal y jur?dica. Se examina c?mo los delitos provocados pobreza extrema y la desigualdad social, pueden influir en la configuraci?n del Derecho penal contempor?neo, proponiendo alternativas que consideren la corresponsabilidad estatal y fomenten un enfoque centrado en la justicia social y los derechos humanos.

El libro forma parte de los trabajos de la ?Red de Investigaci?n Perspectivas Iberoamericanas sobre la Justicia?, financiado por el Ministerio de Ciencia, Innovaci?n y Universidades del Gobierno de Espa?a, con el apoyo del Instituto Ibero-Americano de la Haya para la Paz y los Derechos Humanos (IIH) y la Facultad de Jurisprudencia de la Universidad del Rosario
