Abstract

[ES] La adopci?n de los est?ndares interamericanos sobre el derecho al doble conforme en Ecuador: An?lisis de las sentencias 1965-18-EP/21 y 8-19-IN/21 explica la creaci?n del recurso de doble conforme en materia penal en Ecuador, consecuencia de la vinculatoriedad de la jurisprudencia emitida por la Corte IDH, tomando en cuenta que Ecuador es un pa?s perteneciente a la Organizaci?n de Estados Americanos; por lo que, ha suscrito y ratificado la Convenci?n Americana de Derechos Humanos. Para esta investigaci?n se utiliza la metodolog?a dogm?tica y anal?tica que permiten destacar el impacto del derecho internacional al modificar el sistema procesal penal ecuatoriano y valorar los efectos de las sentencias analizadas, tanto los aspectos que contribuyen en la protecci?n del derecho al doble conforme, como aquellos obst?culos te?ricos que puede afectar otros derechos constitucionales de los ciudadanos. [EN] The adoption of the Inter-American standards on the right to a second hearing in Ecuador: Analysis of judgments 1965-18-EP/21 and 8-19-IN/21 explains the creation of the second hearing recourse in criminal matters in Ecuador, a consequence of the binding nature of the jurisprudence issued by the IACHR Court, taking into account that Ecuador is a country belonging to the Organization of American States; therefore, it has signed and ratified the American Convention on Human Rights. For this research the dogmatic and analytical methodology is used to highlight the impact of international law in modifying the Ecuadorian criminal procedure system and to evaluate the effects of the sentences analyzed, both the aspects that contribute to the protection of the right to a second hearing, as well as those theoretical obstacles that may affect other constitutional rights of citizens.
