Abstract

[ES] El principio de culpabilidad y la responsabilidad subjetiva son condiciones necesarias de las sanciones administrativas. El respeto a la presunci?n de inocencia requiere que la Administraci?n pruebe la culpabilidad. Las advertencias podr?an preparar la prueba y as? mantener las garant?as constitucionales [EN] Guilt principle and subjetive responsability are necessary conditions of administrative sanctions. Respect for the presumption of innocence requires that public administration proofs guilt. Warning could prepare evidence and so maintain constitutional guarantees.
