Abstract

[ES] El objetivo del cap?tulo era ofrecer el enfoque del an?lisis econ?mico del Derecho en un libro colectivo de estudios sobre consumo. La investigaci?n se basa en la asimetr?a de informaci?n y de poder de mercado, lo que permite al grupo de agentes en el lado de la oferta apropiarse de una parte del excedente que en otras condiciones corresponder?an al lado de la demanda, produciendo efectos no deseados en la distribuci?n de la renta. El documento profundiza en la identificaci?n del coste de eficiencia y los efectos de la sustituci?n del principio de mercado (los individuos act?an si sus ganancias son mayores que sus costes individuales) por el principio de autoridad (el Legislador determina una actuaci?n que deben realizar los individuos aunque su saldo individual neto sea negativo), relacionado con las correspondientes cuestiones relevantes desde el ?mbito jur?dico.
