Abstract

[ES]Los delitos de odio son una de las expresiones de mayor lesividad social en relaci?n con la condici?n de las personas desde una doble vertiente de amenaza de da?o a los sujetos pasivos del hecho punible y ruptura de la paz social y de la aceptaci?n de las diferencias concurrentes en las personas que la integran. Procesalmente, depara numerosos retos el an?lisis de las circunstancias que se producen en la investigaci?n y enjuiciamiento de los delitos de odio. Algunos de estos retos se analizan en el presente trabajo, valorando las singularidades tanto a nivel de principios del proceso, como respecto a la declaraci?n de la v?ctima, desde su consideraci?n de v?ctimas especialmente vulnerables o, en ?ltimo t?rmino, la importancia de la prueba indiciaria a trav?s de la utilizaci?n de los denominados ?indicadores de polarizaci?n?. [EN] Hate crimes are one of the expressions of greatest social harm in relation to the condition of people from a double perspective of threat of harm to the passive subjects of the crime and rupture of social peace and acceptance of concurrent differences. in the people who make it up. Procedurally, the analysis of the circum- stances that occur in the investigation and prosecution of hate crimes presents nu- merous challenges. Some of these challenges are analysed in this work, assessing the singularities both at the level of the principles of the process, and with respect to the victim?s statement, from their consideration of especially vulnerable victims or, ultimately, the importance of the circumstantial evidence. using the so-called ?polarization indicators?.
