Abstract

[ES] En el cap?tulo se analizan los aspectos procesales de la ya extinta incapacitaci?n por alguna de las causas del antiguo art. 200 CC. Los procesos sobre capacidad de las personas, que eran los primeros de los procesos especiales regulados en la Ley de Enjuiciamiento Civil, suscitaban un especial inter?s por sus implicaciones conceptuales: se trataba de solicitar una merma considerable en la libertad de actuaci?n de una persona, aunque sea por mor de su propia protecci?n. Aunque estaba pendiente la adaptaci?n plena de la legislaci?n civil y procesal a la Convenci?n de Naciones Unidas sobre los Derechos de las Personas con Discapacidad de 2006, no quer?a decir que en los procesos sobre la capacidad de las personas se desconociera esta Convenci?n , ya que tanto en los ?rganos jurisdiccionales como en el Ministerio Fiscal hab?an permeado las orientaciones de este instrumento internacional, como quedaba patente en la jurisprudencia y los documentos emanados de unos y otros a partir de su firma. Por ello, en este trabajo se tratan los principales aspectos procesales de la incapacitaci?n (objeto procesal competencia, legitimaci?n activa y pasiva, medidas cautelares, especialidades sobre la prueba y sentencia), con atenci?n a esa evoluci?n palpable en la pr?ctica, para finalizar con unas breves notas sobre el Anteproyecto de reforma de 2018.
