Abstract

[ES] La importancia que ha adquirido la Justicia Restaurativa en las ?ltimas d?cadas, de mano con el contexto de crisis que est? sufriendo el Sistema Penal tradicional, ha supuesto el punto de partida id?neo para la implantaci?n de los mecanismos restaurativos en el proceso penal de menores incluyendo su principal representaci?n: la mediaci?n penal. Por tanto, en el presente trabajo de investigaci?n, se pretende realizar un breve recorrido y an?lisis descriptivo sobre la posibilidad de aplicaci?n de los mecanismos de Justicia Restaurativa en el proceso penal del menor, y de los principales presupuestos necesarios para su aplicabilidad en Espa?a. As?, en la primera parte del presente trabajo se har?n referencia a los puntos principales de la Justicia Restaurativa, y, en una segunda, el recorrido de la responsabilidad penal del menor para poder llegar al objetivo final analizando la idoneidad de los mecanismos restaurativos en el proceso penal del menor. [EN] The importance that restorative justice has reached in recent years, is related to the crisis of the traditional criminal Justice System. This has been the ideal starting point for the implementation of restorative mechanisms in the criminal process of minors, including their main representation: criminal mediation. Therefore, in this research work it is intended to make a brief overview and descriptive analysis on the possibility of application of the mechanisms of Restorative Justice in the criminal process of minors, and the main budgets necessary for its applicability in Spain. Therefore, in the first part of this paper, reference will be made to the main points of restorative justice, and, in a second part, the course of the criminal responsibility of the minor to be able to reach the final objective by analyzing the appropriateness of the restorative mechanisms in the criminal process of the minor.
