Abstract

[ES] La justicia restaurativa nace como un modelo alternativo de justicia que se centra en las necesidades de las v?ctimas y de los autores del hecho delictivo, tratando de reparar el da?o y haciendo responsable al autor de sus conductas e involucrando de cierto modo a la comunidad en la propia resoluci?n del conflicto. La mediaci?n penal es la pr?ctica utilizada por la justicia restaurativa en la que interviene un tercero imparcial denominado mediador, cuya funci?n es mediar entre v?ctima-autor para que estos solucionen el conflicto de manera pac?fica y dialogada. A trav?s de este trabajo, se analizar? el proceso de mediaci?n penal centrado en el proceso de menores, es decir, en aquellos autores menores de 18 a?os que cometen un hecho el cual causa un da?o a la v?ctima. Adem?s, se analizar?n aspectos como que ?rganos intervienen, cu?les son las fases de la mediaci?n y la importancia de las entrevistas privadas y de la escucha y comunicaci?n. La mediaci?n es un m?todo eficaz que permite la descongesti?n del sistema y de la justicia actual, el cual deber?a ser m?s utilizado, ya que ayudar?a a solucionar los conflictos que se suscitan en la vida diaria de las personas de una manera menos agresiva. [EN] The Restorative justice was born as an alternative model of justice that focuses on the needs of the victims and the perpetrators of the criminal act. This process tries to repair the damage by making the perpetrator responsable for their behavior, involving the community in a certain way in the resolution of the conflict. Criminal mediation is a practice used by Restorative justice in which an impartial third party called mediator intervenes, whose function is to mediate between the victim-perpetrator so that they resolve the conflict in a peaceful and dialogued manner. Throught this work, the process of criminal mediation focused on the process of minors will be analyzed, that is, on those authors under 18 years old who commit a criminal act which causes harm to the victim. In addition, aspects such as which bodies are involved, what are the phases of mediation and the importance of private interviews and listening and communication will be analyzed Mediation is an effective method that allows the decongestion of the system and the criminal justice. Which should be used more since it would help conflicts that arise in people's daily lives in a less aggressive way.
