[ES] El principio de proporcionalidad y el concepto de ponderaci?n, son elementos jur?dicos de un origen bastante antiguo, pero no por ello se han quedado anticuados, sino que, a trav?s de la jurisprudencia constitucional, se han mantenido vivos en el tiempo y han ido evolucionando en funci?n de c?mo iba evolucionando la sociedad, y con ella, la justicia. A trav?s de este trabajo, nos adentraremos en los or?genes, aspectos principales y elementos clave para obtener un an?lisis certero de la contribuci?n y el estado actual del principio de proporcionalidad en nuestra Constituci?n. Para ello, ser? necesario conocer tambi?n cu?les son las principales cr?ticas a las que se enfrenta, y si se han desarrollado posibles alternativas a la aplicaci?n de este principio. [EN] The principle of proportionality and the concept of balancing, are legal aspects with a quite classic origin, but but they have not become obsolete, but rather, through constitutional jurisprudence, have been kept alive over time and they have been envolving along with the society and the justice. Through this document, we will delve into the origins, main aspects and key elements to obtain an accurate an?lisis about the contribution and the current situation of the principle of proportionality in our Constitution. For this purpose, it will also be necessary to know what are the main criticisms it faces, and whether possible alternatives to the application of this principle have been developed.
