Abstract

[ES] Se conocen con el nombre de ?BigTech? o Gigantes Tecnol?gicos al conjunto de empresas que en los ?ltimos tiempos han sufrido una gran expansi?n, pasando a ocupar una fuerte posici?n de dominio en sus sectores. Entre las principales empresas, tienen un papel destacado las denominadas GAFAM+N, Google, Apple, Facebook, Amazon, Microsoft y Netflix, todas ellas han conseguido en muy poco tiempo, posicionarse como el recurso m?s utilizado por los usuarios frente a sus competidores, elimin?ndolos pr?cticamente del mercado. En ocasiones, esta posici?n de poder de mercado ha sido alcanzada por medio de comportamientos reprobables desde el punto de vista del Derecho de la Competencia, por lo que en el presente trabajo nos dedicaremos a analizar la historia de estas plataformas, para poder entender en cierta medida su gran ?xito, as? como las principales conductas antitrust de las mismas, junto con las medidas que existen y que se proponen, desde el punto de vista del Derecho de la Competencia, para intentar paliar los efectos. El objetivo ?ltimo, es intentar responder a la pregunta de si es necesaria o no una reforma de la normativa vigente en nuestros d?as. [EN] The group of companies that have undergone a great expansion in recent times are known by the name of ?BigTech? or Technological Giants, occupying a strong position of dominance in their sectors. Among the main companies, the so-called GAFAM+N, Google, Apple, Facebook, Amazon, Microsoft and Netflix have a prominent role, all of them have managed in a very short time to position themselves as the most used resource by users compared to their competitors. virtually eliminating them from the market. On occasions, this position of power has been achieved through reprehensible behavior from the point of view of Competition Law, so in this paper we will dedicate ourselves to analyzing the history of these platforms, in order to understand to a certain extent their great success, as well as the main antitrust behaviors of the same, together with the measures that exist and that are proposed, from the point of view of Competition Law, to try to mitigate the effects. The ultimate goal is to try to answer the question of whether or not a reform of the regulations in force today is necessary.
