Abstract

[ES] En la investigaci?n, se abarcan las bases te?ricas sobre la naturaleza del derecho humano al agua y su relevancia con el resto de los derechos humanos. Para ello, se toma como marco de referencia un estado del arte desde el enfoque principal del Derecho internacional, igualmente, se analiza el desarrollo y la evoluci?n del derecho humano al agua, en correlaci?n con los derechos civiles, econ?micos y sociales, y con los recientes derechos o de nueva creaci?n; como su relaci?n con el derecho al desarrollo, a la paz y al medio ambiente adecuado, entre otros de complejo tratamiento, incluyendo los antecedentes del derecho de aguas previo al reconocimiento del derecho de acceso al agua potable y al saneamiento. Tambi?n se ha desarrollado en esta tesis la relaci?n de la falta y escasez de agua potable con los conflictos o guerras por el agua, destacando su origen, uso y destino del agua, como un bien disponible en la naturaleza, pero a su vez escaso y no restituible; en ese sentido, el derecho de acceso al agua potable como una garant?a jur?dica proviene y encuentra su fundamento en el Derecho internacional ya que su reconocimiento universal se basa en una verdad inobjetable: No hay vida sin agua.
