[ES] La tecnolog?a blockchain ha creado una nueva modalidad de contrataci?n electr?nica, la contrataci?n inteligente. Con este trabajo pretendemos realizar una aproximaci?n jur?dica a este tema, esclarecer que se trata de una manifestaci?n novedosa de la modalidad contractual electr?nica y que es posible que, con el ordenamiento jur?dico actual, esta v?a no quede ajena al derecho, pudiendo las partes que opten por desarrollar su negocio jur?dico v?a contrato inteligente confiar en el sistema legal actual, pues en caso de controversia entre las partes, acudir?an a los preceptos legales que regulen la contrataci?n de acuerdo con las caracter?sticas del caso concreto.
[EN] Blockchain technology has created a new form of electronic contracting, smart contracting. The aim of this study is to provide a legal approach to this subject, to clarify that it is a novel manifestation of the electronic contractual modality and that it is possible that, with the current legal system, this method is not alienated from the law. And the parties who choose to develop their legal business via smart contract can rely on the current legal system, since in the event of a dispute between the parties, they would resort to the legal precepts that regulate the contract in accordance with the characteristics of the specific case.
