Abstract

[ES] El correcto funcionamiento de la sociedad se caracteriza por el respeto a un determinado orden social que viene marcado, principlamente, por el cumplimiento de las normas. Entre dichas normas est?n las penales que castigan una serie de conductas que atentan contra bienes jur?dicos individuales y colectivos poniendo en peligro el orden social. Gracias a dichas normas, podemos dividir a la sociedad en dos grandes grupos: los que son capaces de respetarlas, y a aquellos que las vulneran. Entre estos segundos tenemos los delincuentes comunes y los delincuentes incorregibles. Tenemos distintas categor?as de delincuentes incorregibles cuya soluci?n, en muchas ocasiones, es tratarlos como delincuentes habituales por los rasgos en com?n que guardan. Sin embargo, hay parte de la doctrina que sigue hablando de la inocuizaci?n como soluci?n a estos sujetos. ?Qu? es un delincuente incorregible y la soluci?n al mismo?

[EN] The correct functioning of society is characterized by respect for a certain social order that is marked, primarily, by compliance with the rules. Among these norms are the penal ones that punish a series of conducts that threaten individual and collective legal rights, endangering the social order. Thanks to these norms, we can divide society into two large groups: those who are capable of respecting them, and those who violate them. Among these seconds we have common criminals and incorrigible criminals. We have different categories of incorrigible criminals whose solution, in many cases, is to treat them as habitual criminals because of the common traits they have. However, there is part of the doctrine that continues to speak of the innocuation as a solution to these subjects. What is an incorrigible criminal and the solution to it?
