Abstract

[ES] El objeto de estudio del presente trabajo son los cuasicontratos y el enriquecimiento injusto como hechos generadores de obligaciones. De car?cter controvertido, ambos han resultado el epicentro de un fuerte debate doctrinal, enfocado hacia su existencia como categor?as aut?nomas. En este ensayo, se realiza una revisi?n hist?rica de ambas, para tratar de dar respuesta tanto al interrogante acerca de su propia existencia como el de su posterior evoluci?n. Para encuadrar la materia, se hace referencia a la regulaci?n contenida en otros derechos europeos, as? como las propuestas de unificaci?n procedentes del legislador comunitario. La actual doctrina, en su mayor?a, aboga por su desaparici?n, pero sin encontrar unanimidad ni en lo relativo a la eliminaci?n de la categor?a, ni en el modo de realizarlo, continuando con el particular debate en torno a la naturaleza de estas instituciones jur?dicas.

[EN] The thesis' subject matter are quasi-contracts and unjust enrichment as generating events of obligations. Of a controversial nature, both figures have been the center of a great doctrinal debate, focused on their existence as autonomous categories. This essay will proceed to realise a historical revision of both legal entities, trying to answer the interrogants regard-ing their own existence and subsequent evolution. In order to focus on the issue, a reference to the regulation of other european countries will be made, as well as to the proposal of the community legislator.
