[ES] El Derecho de Familia se caracteriza por su continua adaptaci?n a la realidad social. La elevada cifra de divorcios y separaciones en la actualidad ha llevado a que las parejas opten por regular los posibles efectos, tanto econ?micos como personales, que pueda tener una futura ruptura a trav?s de pactos prematrimoniales, o incluso en las mismas capitulaciones matrimoniales. Sin embargo, el Derecho Com?n se limita a regular los cap?tulos, por lo que resulta de especial importancia que el legislador establezca los requisitos de validez y eficacia que requieren los pactos prematrimoniales. El objetivo de este trabajo es realizar un estudio detallado de la evoluci?n y aceptaci?n jurisprudencial de los contratos celebrados entre las parejas para regular su matrimonio y los efectos de una posible crisis conyugal. Para ello se examinar?n los ordenamientos jur?dicos m?s importantes en la materia en Derecho Comparado, y tambi?n la legislaci?n existente en los Derechos Auton?micos espa?oles, especialmente el Derecho Catal?n.

[EN] Family Law is characterized for its continuous adaptation to the social reality. The high number of divorces and separations nowadays has led couples to consider the option of regulating the possible effects, both economical and personal, that a future breakup can cause through premarital agreements or even in the very same prenuptial agreements. However, The Spanish Civil Law limits itself to the regulation of the chapters therefore it is of special importance that the legislator establishes the requirements of validity and efficacy that premarital agreements require. The aim of this Final Degree Project is to carry out a detailed study of the evolution and jurisprudential acceptance of contracts concluded between couples to regulate their marriage and the effects of the marital crisis. Therefore, the most important legal systems through Comparative Law and also the existing legislation in the Spanish Autonomic Rights, especially itemizing Catalonia?s Law.
