[EN] Consent is the foundational act of marriage, which no human power is able to replace. In order to get married validly, there should be three requirements: the capability of the contracting parties to marry, the due consent and the prescripted method. Consent is the most essential of these three requirements. This essay starts specifying the historical antecedents and the current regulation of canonical marriage together with the act of giving consent. From that point on, this work deals with the incapabilities to give valid consent regulated by canon 1095. These incapabilities are the lack of the sufficient use of reason, the grave defect of discretion of judgment and the incapability to assume the essential obligations of marriage due to causes of psychic nature. Eventually, this research paper goes in depth in the study of the incapability to assume conjugal obligations and the psychic causes which originate in the before mentioned inability.

[ES] El consentimiento es el acto constituyente del matrimonio, que ning?n poder humano puede suplir. Para contraer v?lido matrimonio, deben darse tres presupuestos: la capacidad de las partes para contraer entre s?, el consentimiento debido y la forma prescrita. De estos presupuestos, el consentimiento es el m?s esencial. El trabajo comienza desgranando los antecedentes hist?ricos y la regulaci?n actual del matrimonio can?nico y del acto del consentimiento. A partir de ah?, se abordan los tres supuestos de incapacidad para prestar v?lido consentimiento regulados en el c. 1095, esto es, la carencia de suficiente uso de raz?n, la falta de discreci?n de juicio y la incapacidad de asumir las obligaciones esenciales del matrimonio por causas de naturaleza ps?quica. Por ?ltimo, se profundiza en el estudio de la incapacidad de asumir las obligaciones conyugales y en las causas de naturaleza ps?quica que originan esta incapacidad.
