[ES] El aumento de los delitos de odio ha dado lugar que los legisladores tanto europeos como nacionales desarrollen tipos penales para perseguir estos comportamientos. Una de estas conductas es el discurso negacionista, por el cual se niega, trivializa o enaltece los cr?menes de lesa humanidad y los genocidios, principalmente, el Holocausto jud?o. La criminalizaci?n de estos mensajes ha dado lugar a dos doctrinas enfrentadas entre s?. Por un lado, lo que aseguran que castigar estos discursos es esencial para evitar el favorecimiento de un clima discriminatorio que pueda vulnerar el derecho a la dignidad y el derecho a la igualdad de los grupos que por su raza, etnia, identidad sexual o cualquier otra caracter?stica diferencial, puedan verse afectados por la xenofobia, el racismo y la inseguridad que estas acarrean; por otro lado, los que afirman que este delito supone un l?mite a la libertad de expresi?n e ideol?gica y que supone una transgresi?n a los valores y pilares intr?nsecos de las democracias modernas.
[EN] The increase in hate crimes has resulted in both European and national lawmakers developing criminal offenses to prosecute these behaviors. One of these behaviors is the negationist discourse, for which the crimes against humanity and genocides, mainly, the Jewish Holocaust, are denied, trivialized or extols. The criminalization of these messages has led to two doctrines confronting each other. On the one hand, what they say is that punishing these speeches is essential to avoid favoring a discriminatory climate that could violate the right to dignity and the right to equality of groups because of their race, ethnicity, sexual identity or any other differential feature, may be affected by the xenophobia, racism and insecurity that these entail; on the other hand, those who affirm that this crime supposes a limit to the freedom of expression and ideological and that supposes a transgression to the values and intrinsic pillars of the modern democracies.
