Abstract

[ES] El secreto de Estado y los servicios de inteligencia se encuentran en la base de cualquier Estado y tienen el mismo objetivo: proteger la seguridad y defensa nacional. Solo una finalidad tan importante puede legitimar la existencia de ambos, porque suponen una excepci?n al principio de publicidad. Este trabajo tiene una doble finalidad: En primer lugar, tratar el secreto de Estado. El concepto de secreto de Estado y su legitimidad en un Estado democr?tico, puesto que choca con el principio de publicidad que se ha de exigir a la administraci?n p?blica. Tambi?n examinare como se aplican los secretos de Estado en Espa?a, su regulaci?n y los problemas que tiene. Por ?ltimo, examinar? a los servicios de inteligencia, desarrollando el concepto de inteligencia y su importancia para la defensa del Estado. Tambi?n c?mo se desarrolla la actividad de los servicios a trav?s de las labores de inteligencia. Adem?s, hacer un repaso a como se regulan los servicios de inteligencia en Derecho espa?ol, sobre todo el Centro Nacional de Inteligencia, pero haciendo tambi?n una breve referencia al Derecho comparado.

[EN] State secret and intelligence services are at the root of any state and have the same objective: to protect national security and state defence. Only such an important reason can legitimise the existence of both, because they are set up as a exception to the publicity principle. This work has a double purpose: Firstly, to deal with State secret. The concept of State secret and its legitimacy in a democratic State, since it clashes with the principle of publicity that must be demanded from the public administration. I will also examine how State secrets are applied in Spain, their regulations and the problems they have. Eventually, I will review intelligence services, elucidating the concept of intelligence and its importance for the defense of the State. In addition, I will assess how the activity of the services is developed through intelligence work. Furthermore, to review how the intelligence services are regulated in Spanish law, paying special attention to ?el Centro Nacional de Inteligencia?, while briefly referencing comparative law.
