Abstract

[ES] La sociedad siempre ha sentido fascinaci?n por el mundo del crimen. Hoy en d?a, con el desarrollo masivo de las comunicaciones, los asuntos criminales pueden ser conocidos al instante. Sin embargo, todo se complica cuando entran en juego los intereses de los agentes pol?ticos, la sociedad y los medios de comunicaci?n. El presente trabajo analiza c?mo el poder pol?tico, con objeto de conseguir r?ditos electorales, utiliza los sentimientos de crispaci?n e inseguridad generados en la ciudadan?a por el ?nfasis con el que los medios suelen tratar los asuntos criminales, respondiendo con un severo incremento penal, a trav?s del denominado populismo punitivo. Por otro lado, se estudia la influencia directa de los medios en el proceso penal a trav?s de la formaci?n de ?juicios paralelos?, que pueden perjudicar los derechos de las diferentes partes y sujetos procesales, as? como poner en jaque la imparcialidad judicial. Finalmente, se describe la participaci?n del abogado en tales juicios paralelos, y se establecen una serie de recomendaciones para garantizar su correcta relaci?n los medios de comunicaci?n.

[EN] Society has always been fascinated by the world of crime. Today, due to the massive development of communications, criminal matters can be known instantly. However, everything becomes more complicated when the interests of political agents, society and the media come into play. This paper analyzes how the political power, in order to achieve electoral revenues, takes in advantage the feelings of tension and insecurity generated in the citizenship by the emphasis with which the media usually treats criminal matters, responding with a severe criminal increase, through of the so-called punitive populism. On the other hand, the direct influence of the media in the criminal process is studied through the formation of ?parallel trials,? which can harm the rights of the different parties and procedural subjects, as well as putting judicial impartiality in check. Finally, the Lawyer?s participation in such parallel trials is described, and a series of recommendations are established to guarantee the correct relationship with the media.
