Abstract

El presente estudio examina el delito de cohecho pasivo, variable dependiente. Mientras que la variable independiente o explicativa se centra en saber si este tipo de infracci?n penal es mayormente cometida por funcionarios o pol?ticos. La investigaci?n se hace a partir del an?lisis de una muestra de treinta y dos sentencias condenatorias emitidas por el Tribunal Supremo; por tanto, se trata de un estudio de casos. M?todo de investigaci?n que confirmar? la hip?tesis de partida, que esta conducta delictual es m?s propia de funcionarios, pese a la creencia arraigada en la sociedad de que el sujeto activo suele ser el pol?tico. Imagen transmitida por el inter?s de los partidos en utilizar estos procesos como arma arrojadiza contra el adversario. Lo que a la postre impide tener un diagn?stico acertado del mal y obtener consecuentemente las necesarias soluciones para aminorarlo./n?

The present study examines the crime of passive bribery, dependent variable. Whilst the independent variable or explanatory focuses on knowing if this type of criminal offense is mostly committed by civil servants or politicians. The research is based on the analysis of a sample of thirty-two sentences of the Supreme Court; therefore, it is a study of cases. Research method will confirm the baseline hypothesis, that this criminal conduct is more typical of civil servants. Despite the deep-rooted belief in society that the active subject is usually the politician. Image transmitted by the interest of the political parties in using these judicial processes as a weapon against the adversary. Which ultimately prevents having an accurate diagnosis of the evil and consequently obtain the necessary solutions to reducing it.
