[ES] La familia es una instituci?n estudiada por los juristas a lo largo de su historia desde diferentes puntos de vista, seg?n el tiempo y espacio en que se encuadre. Debido a la diversidad de modelos de familia y a los caracteres de multiculturalidad e internacionalizaci?n, se aprecia una creciente dispersi?n de las relaciones familiares acentuada por la libre circulaci?n de personas en el ?mbito de la Uni?n Europea y el acelerado proceso de globalizaci?n. Estas situaciones crean un paradigma jur?dico a la hora de determinar el r?gimen econ?mico matrimonial de los c?nyuges, cuya regulaci?n hasta este momento es determinada por el ordenamiento jur?dico estatal de cada Estado miembro. El objeto de este trabajo es analizar la regulaci?n por parte del Derecho Internacional Privado espa?ol en la determinaci?n de la ley aplicable al r?gimen econ?mico matrimonial, y especialmente, la nueva normativa prevista en el Reglamente (UE) 2016/1103 propuesta como unificaci?n normativa en esta materia.

[EN] The family is an institution studied by law experts throughout its history from different points of view according to the time and space in which it is framed. Due to the diversity of family models and to the character of multiculturalism and internationalization, there is a growing dispersion of family relations accentuated by the free movement of people within the European Union and the accelerated process of globalization. These situations create a legal paradigm when determining the matrimonial economic regime of the couples, whose regulation until now is determined by the national legal order of each Member State. The purpose of this work is to analyze the regulation by Spanish Private International Law of the determination of the law applicable to the matrimonial economic regime, and especially, the new legislation provided for in Regulation (EU) 2016/1103 proposed as a normative unification in this matter.
