[ES] El 1 de febrero del a?o 2015 se firma en Espa?a el Pacto Antiyihadista, que acuerda la creaci?n de la Ley Org?nica 2/2015, cuya modificaci?n en el C?digo Penal va a ser analizada en este trabajo. Sin embargo, de nada sirve el estudio de esta reforma sin entender qu? es el terrorismo, cu?l es la din?mica que est? tomando en las ?ltimas d?cadas y qu? papel tiene el Derecho Penal en todo ello. La suma de todos estos elementos nos devuelve a una realidad convulsa, donde el papel de la ley cobra cada vez m?s importancia para resolver todo tipo de problemas. El terrorismo es tratado como una cuesti?n global a la que los gobiernos occidentales intentan hacer frente con un recorte de garant?as y derechos fundamentales, haciendo protagonista el viejo dilema seguridad ? control. Este trabajo examina el panorama internacional del terrorismo, desde la perspectiva social y la perspectiva del Derecho, junto con las Decisiones Marco de la Uni?n Europea y la creciente propagaci?n de un Derecho Penal del enemigo que envuelve a las sociedades de hoy en d?a con un uso muchas veces pol?tico.

[EN] On February 1, 2015, the Anti-Jihadist Pact is signed in Spain, which agrees to the creation of Organic Law 2/2015, whose modification in the Penal Code will be analyzed in this work. However, it is useless to study this reform without understanding what terrorism is, what dynamics it is taking in the last decades and what role criminal law has in all of this. The sum of all these elements returns us to a convulsive reality, where the role of the law becomes increasingly important to solve all kinds of problems. Terrorism is treated as a global issue to which western governments try to cope with a reduction of fundamental rights and guarantees, highlighting the old security - control dilemma. This paper examines the international panorama of terrorism, from the social perspective and the perspective of law, together with the European Union's Framework Decisions and the increasing spread of an Enemy Criminal Law that involves today's societies with a use often political.
