[ES] La realidad jur?dica actual nos muestra las deficiencias existentes en el sistema judicial y ello ha generado la necesidad de un cambio de paradigma. Dicho cambio es susceptible de venir impulsado por diferentes m?todos alternativos de resoluci?n de conflictos, entre los cuales encontramos la mediaci?n. En el presente trabajo se aborda una investigaci?n relativa a lo que ofrece la mediaci?n penal, una opci?n que presenta diversas ventajas, a la par de inconvenientes, como puede ser la falta de regulaci?n de la misma, y por ende el escepticismo de los operadores jur?dicos a aplicarlo. Junto con la investigaci?n de la figura de la mediaci?n penal tambi?n se analiza el cambio que debe sufrir la justicia actual, basada en la filosof?a de justicia retributiva para evolucionar hacia una filosof?a de justicia restaurativa, que centra su atenci?n en la reparaci?n del da?o causado a la v?ctima. De lo expuesto se deduce que resulta incuestionable que la labor que debe llevar a cabo el legislador es fundamental en esta materia. En el presente trabajo se exponen ciertas reformas a elaborar por el mismo para velar por la implantaci?n de esta instituci?n.

[EN] The current legal reality shows us the shortcomings which exists in the judicial system and this has generated the need for a paradigm shift. This change is likely to come boost for different alternative methods of conflict resolution among which we find mediation. In the actual work an investigation is approached regarding what the criminal mediation offers, an option that shows different advantages, along with drawbacks, how can it be the lack of regulation of the same and therefore the skepticism the legal operators to apply it. Together with the investigation of the figure of the criminal mediation, the change that the current justice must undergo is also analyzed, based on the philosophy of retributive justice to evolve towards a philosophy of restorative justice that focuses its attention on the repair of the damage caused to the victim. From the above, it follows that it is unquestionable that the work to be carried out by the legislator is essential in this matter. In the present work, certain reforms to be developed by the same are exposed to ensure the implementation of this institution.
