Abstract

[EN] In this project the attention is focused in the laws of prevention in terms of occupational risks that mainly afect, not only women?s work, but also the actions we have to take in order to guarantee their protection. In this way, it is mentioned the discrimination suffered by women as a consequence of this fact, at the time women began to take part into the labour market, and the way laws have evolved from protection, paternalism to neutral, considering only pregnant women as a especial cause to be enshrined into the legislation. Based on the analysis made, we are going to consider the subjective scope which is affected by the specific regulations related with maternity, which encompass either women during their breastfeeding period or procreation. Taking this into account, in this project, it is not only portrayed the dutty of the company?s director when an accurate evaluation of occupational risks has to be made, but also the the actions that have to be taken by the company?s manager in order to prevent this occupational risks, considering in every case the particular circumstances of each women. Eventually, in the analysis is also convey the En este trabajo nos centraremos en la legislaci?n sobre prevenci?n de riesgos laborales que afecta a la mujer trabajadora, as? como a las medidas que hay o habr?a de adoptar para conseguir una efectiva protecci?n a las mismas. Se hace referencia a la discriminaci?n sufrida hacia la mujer al respecto, cuando ?stas comenzaron a ser part?cipes del mercado laboral y a la evoluci?n de las leyes que pasan de ser protectoras, paternalistas, a neutrales, considerando ?nicamente como circunstancia especial a la mujer, lo relacionado con la maternidad. Con dicho estudio, vamos a observar que el ?mbito subjetivo al que afectan las normativas especificas a la maternidad, son las mujeres embarazadas, en periodo de lactancia o incluso en periodo de procreaci?n y hacemos alusi?n a la obligaci?n del empresario a la hora de llevar a cabo una evaluaci?n de los riesgos adecuada y a elaborar las medidas de prevenci?n de riesgos laborales de acuerdo a las circunstancias de cada trabajadora. As? como por ?ltimo, hacemos alusi?n a la importancia de adoptar medidas de prevenci?n de riesgos laborales en cuanto al acoso laboral, considerado como un riesgo psicosocial que ha de tener en cuenta el empresario en sus obligaciones de prevenci?n. importance of adopting actions to avoid occupational risks regarding to workplace harassment, deeming this fact as a psychosocial risk that the company?s manager has to include into his or hers obligations of prevention.
