Abstract

El sistema de valoraci?n legal de la prueba hace tiempo que est? claramente marginado en el proceso civil, y es legalmente inexistente en el proceso penal. Sin embargo, la larga vigencia del mismo, m?s por el uso forense que por disposici?n legal, ha determinado que actualmente todav?a se encuentren inexplicables manifestaciones del antiguo sistema que deben ser abolidas./nEntre ellas se cuentan la valoraci?n, todav?a legal, de la prueba documental en el proceso civil, los juramentos y promesas, incomprensibles hoy en d?a, as? como la propia concepci?n de la mism?sima carga de la prueba, o incluso el estudio de las presunciones. Todo ello conserva a d?a de hoy un an?lisis impropio de un sistema en el que rige la libre valoraci?n de la prueba, lo que impide el pleno desarrollo cient?fico de este sistema, que afecta, l?gicamente, a la pr?ctica de los tribunales.

The legal evaluation system of evidence has long been clearly marginalized in the civil process, and is legally non-existent in criminal proceedings. However, its long validity due to the tribunals? praxis ?more than by legal provision?, causes inexplicable manifestations of the old system that are still present and must be abolished./nThese manifestations include the legal assessment of documentary evidence in civil proceedings, or the existence of oaths and promises, ununderstandable today, as well as the outdated conception of the burden of proof, or even an also outdated study of circumstantial evidence. All this provokes today an improper analysis of a system in which the free evaluation of evidence shall govern, and prevents the full scientific development of this system, which logically affects the practice of the courts.

/nEn el presente trabajo se indica c?mo proceder a la debida correcci?n y eliminaci?n de esos arrastres del pasado.

/nThis paper indicates how to correct and eliminate these trawls of the past.
