Abstract

[ES]Las drogas han tenido diversos usos a lo largo de la historia. La evoluci?n de la sociedad, de los mercados, de las telecomunicaciones, de la tecnolog?a, etc. ha provocado que el tr?fico de drogas tambi?n lo haga y con ello que se convierta en un gran problema a nivel mundial en distintos ?mbitos. Existen dos tendencias, una prohibicionista cuyo fin se basa en hacer que las drogas desaparezcan por completo y castigar aquellas conductas relacionadas con esta materia que se encuentren fuera de la legalidad. Por el contrario, existe otra tendencia a legalizar o despenalizar el uso de estas sustancias que opta por una regulaci?n jur?dica y pol?tica distinta. Espa?a sigue una l?nea prohibicionista pero con ciertos matices pues no todas las drogas causan el mismo da?o a la salud. De esta manera, se penalizan de diferente forma dependiendo de si se trata de una sustancia que causa grave da?o a la salud o no y en funci?n de la conducta de que se trate. Adem?s, tambi?n se penaliza de forma distinta seg?n si la persona que comete el delito es adicto o no. Es necesario estudiar estas propuestas y ver que posibles efectos positivos y negativos pueden llegar a tener, compararlos con los efectos que provoca una regulaci?n prohibicionista y optar por la opci?n pol?tico criminal m?s id?nea para abordar el fen?meno.

[EN]Drugs had different applications throughout history. The evolution of society, markets, telecommunications, technology etc. has caused drug trafficking to evolve as well and therefore it turned into a global problem in many areas. There exists a prohibitionist approach whose goal is to make drugs completely disappear and to punish those behaviours which are outside the law. On the contrary, there is another approach defending the legalization and decriminalization in the use of narcotics which aims for a different legal and political regulation. Spain follows a prohibitionist policy with certain nuances, since not all drugs cause the same damage to human health. This means the punishment will vary depending on the harm to the human health and as a function of the behaviour in question. Furthermore, the punishment will also differ relying on whether the individual being accused is addict or not. All the proposals must be examined to see what positive or negative effects could have, compare them with the effects caused by a prohibitionist regulation and choose the more convenient political-criminal option to address this phenomenon.
