Abstract

[ES] Los derechos sociales son derechos prestacionales que nacen con el ser humano. Los principales textos, tanto a nivel nacional como internacional los recogen. En Espa?a est?n contenidos en la Constituci?n Espa?ola. Nuestro pa?s es un Estado Social, en el que los poderes p?blicos deben de garantizar el igual acceso a los recursos, lo que exige un papel activo para el Estado para facilitar su cumplimiento. El problema que presentan estos derechos es que no siempre van a poder ser cubiertos de manera efectiva y para todos, especialmente en per?odos de crisis o recesi?n econ?mica, en tanto que suponen un importante gasto social, ocasionando una creciente exclusi?n social en los sectores m?s desfavorecidos de la poblaci?n. Un derecho social de notable importancia es el derecho al medio ambiente, reconocido en la Constituci?n Espa?ola en el art?culo 45, puesto que de su respeto depende el bienestar de las generaciones presentes y futuras. Relacionado con este derecho, hay que prestar especial importancia al problema que presentan los denominados ?agentes externos?, invasores como los gases t?xicos, ruido, o radiaci?n que, eventualmente pueden acceder a nuestros hogares, dificultando la garant?a de este derecho constitucional.
