[ES]En el a?o 2008 estall? la crisis econ?mica en Espa?a. Para lograr la consolidaci?n fiscal, se aplicaron numerosas pol?ticas de austeridad que afectaron, fundamentalmente, a la contenci?n del gasto en pol?ticas sociales. El Real Decreto-ley 16/2012 fue el instrumento que se utiliz? para aplicar los recortes en sanidad. Antes de la entrada en vigor del RDL 16/2012, el sistema legal que regulaba el acceso a la sanidad p?blica espa?ola, tend?a a la universalidad. Los espa?oles y los extranjeros disfrutaban del derecho a la protecci?n de la salud (art. 43 CE) en las mismas condiciones. Sin embargo, tras la entrada en vigor del RDL 16/2012, la titularidad del derecho a la protecci?n de la salud se restringe a aquellas personas que ostentan la condici?n de ?asegurado? o ?beneficiario?. Se excluye de la cobertura sanitaria p?blica a diferentes colectivos, entre los que destacamos por su vulnerabilidad a los extranjeros en situaci?n irregular. Este RDL 16/2012 ha sido objeto de numerosos recursos de inconstitucionalidad. La STC del recurso interpuesto por Navarra fue denegatoria y en ella se formularon dos votos particulares. El an?lisis comparativo del voto mayoritario y el minoritario de esta STC (139/2016) va a ser tan esclarecedor como sustancioso.
[EN]In 2008 the economic crisis broke out in Spain. In order to achieve fiscal consolidation, numerous austerity policies were implemented, which basically affected the containment of social policy spending. The Royal Decree-Law 16/2012 was the instrument used to apply cuts in health. Before the entry into force of RDL 16/2012, the legal system that regulated access to Spanish public health, tended to universality. Spaniards and foreigners benefited from the right to health protection (Article 43 EC) under the same conditions. However, after the entry into force of RDL 16/2012, ownership of the right to health protection is restricted to those persons who are "insured" or "beneficiary". It excludes from the public health coverage to different groups, among which one should be noted for its vulnerability: foreigners in an irregular situation. This RDL 16/2012 has been the subject of numerous appeals of unconstitutionality. The STC of the appeal filed by Navarra was denied and in it were formulated two particular votes. The comparative analysis of the majority and minority vote of this STC (139/2016) will be as enlightening as it is substantial.
