Abstract

[ES] Hoy en d?a, el consentimiento informado se ha convertido en un elemento esencial de la relaci?n m?dico-paciente, cuyo incumplimiento puede generar la responsabilidad de los sanitarios. Sin embargo, su regulaci?n ha suscitado numerosas interpretaciones, sobre todo en materia de qui?n debe otorgar el consentimiento si el paciente se encuentra en la minor?a de edad. Tras la reforma introducida en la Ley 26/2015, la capacidad del menor de edad para dar el consentimiento ha sido restringida y aunque tenga m?s de diecis?is a?os ser?n sus padres los que consientan por representaci?n cuando no sean maduros o se trate de actuaciones de grave riesgo para su salud. En los dem?s casos se aplica la doctrina del menor maduro, por la cual se entiende que el menor puede otorgar el consentimiento por s? mismo si comprende intelectual y emocionalmente el alcance de la intervenci?n. En este trabajo estudiaremos los problemas de interpretaci?n que surgen al aplicar las normas sobre el consentimiento m?dico informado de los menores de edad, haciendo especial hincapi? en lo que ha supuesto la reforma del a?o 2015 sobre esta materia.

[EN] Informed medical consent has become essential in doctor-patient relations, and its absence may entail legal responsability on the side of the medical provider. However, the regulation of the medical consent is controversial, especially when it comes to who is responsible for providing such consent if the patient is a minor. After the reform introduced by the Ley 26/2015, there has been a restriction of the minor?s capacity to consent. Therefore, in cases where the minor is not considered mature enough or where there is a serious health risk involved , even if the minor is older than sixteen it will be his parents who will provide the consent in his name. The mature minor doctrine is applied in all other situations. According to this doctrine, the minor can provide consent if he is able to understand the implications of the medical intervention both intellectually and emotionally. This paper will focus in the analysis of the problems that may arise in the interpretation of the applicable rules regarding the informed medical consent of minors, with a special analysis of the effects of the 2015 reform in the area.
