[EN] Actually, we find a lot of changes in the Spanish society, and concretely of the Spanish family, the mother has joined to the labor life and already she does not devote himself exclusively to the domestic tasks that include the care of the children. This new situation has supposed that after the matrimonial crises appears another guard's possibility and custody named guards and shared custody. The aim of this work is to analyze of what the above mentioned familiar measure consists, as well as exhibit which are his principal characteristics, the criteria and suppositions of attribution, and his advantages and disadvantages; all this, after the study of the both state and autonomous procedure that regulate the shared custody; and of jurisprudence of the Supreme Court that has been the "father" of this measure since it has been outlining and completing this juridical figure up to the point of considering it to be a "normal and even desirable" measure, as well as that it is necessary to adopt always attending to the top interest of the minor, another important aspect that deserves special mention in this work. Definitively, across this study we will be able to conclude if it is a measure more identical than the guard and single-parent custody on having be compared better to the new social familiar reality.

[ES] Actualmente, nos encontramos con una gran transformaci?n de la sociedad espa?ola, y concretamente de la familia espa?ola, la madre se ha incorporado a la vida laboral y ya no se dedica exclusivamente a las tareas dom?sticas que incluyen el cuidado de los hijos. Esta nueva situaci?n ha supuesto que tras las crisis matrimoniales aparezca otra posibilidad de guarda y custodia denominada guarda y custodia compartida. El objetivo de este trabajo es analizar en qu? consiste dicha medida de crisis familiar, as? como exponer cu?les son sus caracter?sticas principales, los criterios y supuestos de atribuci?n, y sus ventajas e inconvenientes; todo ello, tras el estudio de las normas tanto estatales como auton?micas que regulan la custodia compartida; y de la jurisprudencia del Tribunal Supremo que ha sido el ? padre? de esta medida pues ha ido perfilando y completando esta figura jur?dica hasta el punto de considerarla como una medida ?normal e incluso deseable?, as? como que se debe adoptar siempre atendiendo al inter?s superior del menor, otro aspecto importante que merece especial menci?n en este trabajo. En definitiva, a trav?s de este estudio podremos concluir si es una medida m?s acorde que la guarda y custodia monoparental al equipararse mejor a la nueva realidad social familiar.
