La accesibilidad universal en la Ley de Propiedad Horizontal

Abstract

[EN] The overall aim of this paper is to analyse the legal regulations regarding accessibility works in owner?s communities brought under the Condominium legal framework. We will pay attention briefly to the most important reforms carried out in this field, up to that established by the Law 8/2013, June 26th, dealing with urban restoration, regeneration and renewal. We will concentrate on both the compulsory character of these works, as well as on those cases when the neighbourhood board must approve them, analysing the different judicial and extrajudicial proceedings which owners harmed by the decisions adopted in the board can beneficiate from. We will pay special attention to the contesting of those resolutions concerning the installation of lifts.

[ES] El trabajo tiene por objeto analizar el r?gimen de las obras de accesibilidad en las comunidades sujetas al r?gimen de Propiedad Horizontal, repasando brevemente las reformas m?s importantes que se han sucedido en la materia, hasta llegar a la operada por la Ley 8/2013, de 26 de junio, de rehabilitaci?n, regeneraci?n y renovaci?n urbanas. Estudiaremos cuando dichas obras tienen car?cter obligatorio y cu?ndo deber?n ser aprobadas por la Junta as? como las v?as judiciales y extrajudiciales con que cuentan los propietarios que se sientan perjudicados por los acuerdos adoptados por la comunidad. Haciendo especial referencia a la impugnaci?n de los acuerdos adoptados en relaci?n a la instalaci?n de ascensores.
