La declaraci?n del coimputado como medio de prueba

Abstract

[ES] La declaraci?n del coimputado como medio de prueba es fundamental en los procesos en los que existen varios imputados ya que, por encontrarse imputado en la causa, podr? aportar mayor informaci?n acerca de los hechos. Pero para que la declaraci?n del coimputado pueda ser prueba de cargo y desvirtuar la presunci?n de inocencia, derecho constitucional (art. 24.2 CE), el TC aplica la doctrina de la corroboraci?n. Y es que, para que aquella declaraci?n, si es prueba ?nica, pueda ser prueba de cargo, tiene que aparecer m?nimamente corroborada a trav?s de otras pruebas externas que confirmen la participaci?n del imputado en los hechos que el Tribunal considera probados (doctrina actual). Esta doctrina ha surgido a ra?z del papel especial que ostenta el coimputado en el proceso, puesto que se trata de una figura h?brida entre el imputado y el testigo y con el importante apunte de que no tiene el deber de decir la verdad bajo juramento o promesa, a diferencia del testigo, ya que ostenta los derechos del imputado; as?, tiene derecho a no declarar y a no confesarse culpable. Por esto mismo, el Tribunal tiene que cerciorarse de alguna manera de que su declaraci?n es cre?ble y veros?mil a trav?s de otros medios de prueba externos.

[EN] Since the co-defendant is able to provide information about the facts, his statement as evidence is fundamental on trials where there are several persons under legal proceedings. So as to be considered as evidence and distort the presumption of innocence under the Constitutional Law (art. 24.2 CE), the Constitutional Court applies the doctrine of corroboration. In order to be considered as evidence, the declaration must be least confirmed through external testing that verifies the participation of the person under investigation on the deeds that the Court considers proved (current doctrine). This doctrine has come up as a result of the importance that has the co-defendant on the process because he is a hybrid figure between the defendant and the witness. Together with the important point that he does not have to say the truth under oath or promise. They differ with the witness on the rights of the suspect. Thus, he has the right not to declare and not to declare himself guilty. For this reason, the Court has to assure itself in some way that the statement provided is credible and plausible through other external evidence.
