De la proactividad a la prevenci?n en materia ambiental

Abstract

Este cap?tulo explica el concepto de la proactividad en materia ambiental y en el ?mbito de la salud p?blica, a partir del caso de estudio del uso del Glifosato en las campa?as de aspersi?n contra cultivos de uso il?cito en Colombia. Nuestra propuesta se sustenta en una distinci?n entre acci?n proactiva-positiva y acci?n proactiva-negativa, siendo la primera la que permite entender que el ser humano es resiliente por naturaleza, y la segunda la que lleva al Estado a no intervenir ante situaciones de vulnerabilidad evidenciable, bajo un supuesto de ponderaci?n err?nea de derechos afectados. Al estar despejado este escenario, este cap?tulo se adentra en el concepto de condiciones de certeza cient?fica absoluta, para invocar o descartar la aplicaci?n del principio de precauci?n. Acto seguido, y vali?ndonos del l?mite de razonabilidad sobre las evidencias cient?ficas ante un riesgo potencial e inminente, se plantea la aplicaci?n del principio de prevenci?n cuando tal l?mite es superado. La derivaci?n de las reflexiones resultantes, facilita la labor de protecci?n en el citado caso de estudio, siendo ?ste el siguiente paso en el restablecimiento de los derechos vulnerados de los afectados con la aspersi?n a?rea con Glifosato.
