Abstract

[ES] El avance de las nuevas tecnolog?as en el ?mbito de la reproducci?n asistida plantea una serie de conflictos que corresponde al derecho resolver. Este trabajo se centra en el anonimato del donante en las donaciones de gametos, as? como en las causas, reguladas legalmente, en las que este cede a favor del inter?s del hijo, lo cual, en ning?n caso, va a suponer la determinaci?n de la filiaci?n, quedando esto expresamente prohibida en nuestro ordenamiento. Tras una breve comparativa con diferentes reg?menes de nuestro entorno cultural, podemos adoptar una visi?n comparativa de c?mo se abordan estas cuestiones en los diferentes ordenamientos jur?dicos. Finalmente, el anonimato de las donaciones nos va a plantear dos cuestiones relevantes en la actualidad, el derecho a una identidad gen?tica del nacido mediante t?cnicas de reproducci?n asistida, as? como a conocer su propio origen biol?gico, para lo cual analizaremos el pronunciamiento de diferentes sectores doctrinales.

[EN] The advance of new technologies in the field of assisted reproduction raises a number of conflicts that corresponds to the law to find a solution. This work focuses on donor anonymity in gamete donations, as well as the causes, legally regulated, where this gives way to the interests of the child, which in no case will involve determining the affiliation, this being expressly forbidden in our legal system. After a brief comparison with different regimes of our cultural environment, we can adopt a comparative view of how these issues are tackled in different legal systems. Finally , the anonymity of donations going to raise two important issues at present, the right to a genetic identity born through assisted reproduction techniques and to know their own biological origin , for which analyze the pronouncement of different doctrinal sectors.
