Abstract

[ES] El dopaje es una pr?ctica que tiene por objeto modificar las capacidades f?sicas y ps?quicas de un deportista a trav?s de diversos m?todos u otras sustancias que est?n prohibidos en el deporte, con el fin de aumentar el rendimiento tanto f?sico como ps?quico en competici?n, aunque el derecho penal s?lo castiga que el fin sea el aumento del rendimiento f?sico. Es importante analizar a partir de qu? l?mite interviene el derecho administrativo sancionador y cu?ndo realiza su intervenci?n el derecho penal en el castigo del uso de estas sustancias, respetando siempre el principio non bis in idem. A lo largo de este trabajo nos centraremos en el estudio de esta figura delictiva desde la ?ptica de nuestro derecho penal, analizando el respeto al principio non bis in idem, cu?ndo pasa de ser il?cito administrativo a convertirse en delito, as? como el sistema de colaboraci?n que siguen autoridades judiciales y administrativas en el enjuiciamiento de ?ste.

[EN] Doping is a practice which tries to modify physical and mental endurance to combat physical fatigue increasing human abilities by the use of several substances that are forbidden in competition. Penal law only sanctions that behaviour which is related to the increasing of physical resistance but not mental one. It?s important to appreciate the limit beyond which penal law starts its function, trying to respect double jeopardy principle -which involves not judging someone for the same case more than once- In this essay, we will focus on this penal figure by the optic of Spanish criminal law, the distinction between administrative law and penal law in the punition of doping and the way judicial and administrative instances collaborate between each other in the persecution or repression of doping.
