Abstract

El presente ensayo guarda como primer objetivo describir la evoluci?n que ha tenido el derecho mexicano en torno a la regulaci?n del trabajo infantil. As?, se parte del an?lisis de las primeras normas de car?cter federal que regularon dicho fen?meno social, para finalizar en el estudio de las reformas realizadas en los a?os 2012 y 2014 a la Ley Federal del Trabajo y al art?culo 123 Constitucional,respectivamente; reformas con las que fue posible armonizar el derecho mexicano con los instrumentos internacionales que protegen los derechos humanos de ni?as y ni?os, los cuales tambi?n han sido objeto de estudio en el presente trabajo. Sumado a ello,y como segundo objetivo del presente trabajo,se analiza la reforma realizada en el a?o 2002 al art?culo 175 Bis de la Ley Federal del Trabajo, a fin de demostrar la inconstitucionalidad de dicho art?culo y su incompatibilidad con los documentos internacionales que postulan el principio del inter?s superior del ni?o, debido a que dicho numeral excluye de las modalidades de trabajo infantil las actividades art?sticas, cient?ficas, deportivas, etc.,que realizan los menores de catorce a?os.

[EN]This essay contains two main objectives.First, to describe the evolution of Mexican law regarding child labour regulation, and consequently, to establish a chronological normative analysis from the creation of the first federal legislation on the subject, up until the 2012 reform on Federal Labour Law and the 2014 amendment made to article 123 of the Mexican Constitution; such reforms have allowed the harmonization between Mexican law and children's human rights treaties, which are also examined in this work. Second, to analyze the 2002 reform on article 175 Bis of the Federal Labour Law with the intent to evidence its unconstitutionality and incompatibility with international instruments that proclaim the best interest of the child principle, which excludes from child labour any artistic, scientific and sporting activities performed by children under fourteen years old.
