Abstract

[ES] Los medicamentos actualmente son indispensables para el tratamiento de enfermedades. Este trabajo trata los criterios que permiten determinar cu?ndo son indemnizables los da?os que derivan de los defectos de los medicamentos. Para ello, se realiza un examen del sistema de responsabilidad por productos defectuosos, contenido actualmente en el Libro III del Texto Refundido de la Ley General para la Defensa de Consumidores y Usuarios.

[EN] Medicinal products are indispensable for the treatment of illness. This paper explains the criteria to determine when the damages associated to medical products could be compensated. For that, we do an exam about the liability system for defective products contained in the 3rd book of the General Law for the Defense of Consumers and Users.
