Abstract

[ES] El Derecho de defensa de la Competencia siempre se ha considerado como una rama jur?dica que s?lo ata?e a las empresas pero, puesto que ?stas concurren en un mercado que es lugar de encuentro entre oferentes y demandantes, se antoja capital la adecuada articulaci?n de los medios de defensa de estos ?ltimos cuando sufran da?os derivados de la actuaci?n anticompetitiva de las primeras. Este trabajo tiene por objeto desgranar el origen y la evoluci?n de esta aplicaci?n privada del Derecho de la Competencia, centr?ndose especialmente en la Propuesta de Directiva de 16 de junio de 2013, que tiene dos objetivos. El primero de ellos es el pleno resarcimiento de las v?ctimas de los il?citos antitrust, a prop?sito del cual estudiaremos la figura de la passing-on. El segundo es la interacci?n de la aplicaci?n privada con la aplicaci?n p?blica, donde veremos el encaje de los programas de clemencia.

[EN] The Competition Law has always been considered as a businesses-related branch of Law but, as these businesses get together in a market which is a meeting point for suppliers and demanders, it seems essential a proper organization of the defence actions available for these demanders when they experiment pain and suffering coming from the anti-competitive conduct of the businesses. The objective of this project is developing the origin and evolution of this private enforcement of the Competition Law, focusing on the Draft Directive of 16th june 2013, which has two main goals. The first of them is the full compensation of the victims of antitrust activities, the purpose being to study the passing-on figure. The second goal is the interaction between private and public enforcement, where we will consider the leniency programs fitting.
