La capacidad de obrar a la luz del art.12 de la Convención de Naciones Unidas sobre Derechos de las Personas con Discapacidad (CNUDPD)

Abstract

La entrada en vigor la Convención de Naciones Unidas sobre los Derechos de las Personas con Discapacidad (CDPD) en 2008 exigía la adaptación del ordenamiento jurídico español a su espíritu y dictados. España debía abolir el tradicional sistema de incapacitación basado en la sustitución en la toma de decisiones y expulsar de su ordenamiento jurídico cualquier restricción o anulación de la capacidad de obrar, pues el nuevo paradigma reconoce la plena capacidad jurídica, concepto que incluye el de capacidad de obrar. El ordenamiento jurídico español todavía mantiene el tradicional sistema a abolir, pero se han dado pasos importantes avanzando hacia la plena igualdad de las personas con discapacidad. Esta tesis doctrinal analiza los avances seguidos en tal dirección; así como las contradicciones existentes respecto al modelo de asistencia a implementar y las fricciones entre nuestro ordenamiento jurídico y los diversos tratados internacionales vigentes ratificados por España.
