Personal laboral interino en la administración pública

Abstract

Trabajo Fin de Máster en Dirección y Gestión de Personas (Curso 2021-22). Tutora: Dra. Dª. Luisa Pérez Guerrero. En el presente trabajo se pretende plantear las dificultades que concierne al régimen jurídico del personal laboral interino en España y el abuso por parte del sector público español de esta figura, debido al uso de contratos temporales para el ejercicio de sus funciones durante largos periodos de tiempo, provocando una serie de condiciones que son incompatibles con nuestro ordenamiento jurídico, sobre todo a la estabilidad en el empleo. Se ha analizado el pronunciamiento por parte del Tribunal Superior de Justicia de la Unión Europea en relación con el caso “Diego Porras”, y como interfirió la Directiva 1999/70/CE y su Acuerdo Marco, ocasionando la modificación de normas nacionales al respecto de la extinción de los contratos de sustitución por vacantes en nuestro país. Asimismo, se realiza un estudio sobre sobre el proceso de estabilización de empleo temporal en el sector público a través de la Ley 20/2021 de 28 de diciembre, estableciéndose una serie de medidas para poder llevar a cabo un proceso de selección ágil por parte de la Administración Pública.

In the present work it is intended to raise the difficulties that concern the legal regime of temporary labor personnel in Spain and the abuse by the Spanish public sector of this figure, due to the use of temporary contracts for the exercise of their functions for long periods of time, causing a series of conditions that are incompatible with our legal system, especially to job stability. The ruling by the Superior Court of Justice of the European Union in relation to the “Diego Porras” case has been analyzed, and how Directive 1999/70 / CE and its Framework Agreement interfered, causing the modification of national regulations regarding the the extinction of interim contracts for vacancies in our country. Likewise, a study is carried out on the stabilization process of temporary employment in the public sector through Law 20/2021 of December 28, and its draft law RD-law 14/2021, establishing a series of measures to be able to carry out an agile selection process by the Public Administration.
