La relación de la Corte Penal Internacional con el Consejo de Seguridad y la Corte Internacional de Justicia

Abstract

Trabajo fin de Máster dirigido por Carmen Márquez Carrasco. El presente trabajo de investigación trata de establecer 3 puntos. El primero es la naturaleza jurídica tanto del Estatuto de Roma como de la Corte Penal Internacional, estableciendo si se asemejan a una estructura parecida, o que tanto el Estatuto como la Corte Penal tienen características propias con lo cual salen de la esfera común de los tratados y de los tribunales internacionales respectivamente. El segundo punto es establecer que existe una gran relación entre la Corte Internacional de Justicia y la Corte Internacional abarcando la competencia consultiva y jurisdiccional de la Corte Internacional superando con esto al Estatuto de Roma que solo menciona esta relación en el artículo 119.2. En este punto en particular se tocarán los posibles casos que se pueden dar ante la Corte Internacional de Justicia en donde se tenga que activar su función jurisdiccional para resolver posibles conflictos entre el Estatuto de Roma y obligaciones internacionales. Por último se abordará el tema de la independencia de la Corte Penal Internacional ante el Consejo de Seguridad y si las resoluciones del Consejo son obligatoria para la Corte Penal jurídicamente hablando.
