Abstract

[Esp]El sistema económico actual ha generado un problema en materia de poder de los trabajadores sobre sus derechos laborales. Ante esta situación, la negociación colectiva (y los convenios colectivos como resultado de ella) son una herramienta fundamental para llegar a acuerdos entre empleados y empresarios. Las entidades de economía social se organizan de modo que favorecen la propiedad y la capacidad de gestión de los trabajadores en la empresa. El objetivo del presente trabajo es conocer la capacidad de mejora real de las condiciones de los trabajadores por parte de las entidades pertenecientes a la economía social en contraste con el de las empresas capitalistas. Para ello, se han comparado los derechos recogidos en los convenios colectivos de ambos tipos de entidades. El corpus lo forman seis convenios: tres empresas de economía social y tres sociedades anónimas, todas pertenecientes al mismo sector. El documento permite concluir que debido al poder que tienen los empleados en la toma de decisiones su poder de negociación se ve mejorado, aunque las condiciones laborales, plasmadas en el convenio colectivo, mejoran levemente con respecto a las sociedades anónimas. [Eng]The existing economic system has created a problem in terms of workers' power over their labor rights. In this situation, collective bargaining -and the collective agreements that result from it -are a fundamental instrument for reaching agreements between employees and employers. The aim of this paper is to know the capacity of real improvement of the workers' conditions by the entities belonging to the social economy in contrast to the capitalist companies. To this end, we have compared the rights contained in the collective agreements of both types of entities. Six agreements form the corpus: three social economy companies and three public limited companies belonging to the same sector. The study concludes that the decision-making power of the employees has improved their bargaining power, although the working conditions, as reflected in the collective agreement, are slightly more favourable than those of the public limited companies.
