Caso fortuito e colpevolezza nella contravvenzioni ambientali

Abstract

Il presente contributo analizza l’utilizzo dell’istituto del caso fortuito nell’ambito delle contravvenzioni ambientali, prevalentemente discusso dalla dottrina e dalla giurisprudenza nei casi in cui sussistono “fattori esterni” (guasti tecnici, eventi atmosferici imprevedibili e condotte di terzi) idonei ad incidere sulla rimproverabilità del soggetto agente. Si conduce un’analisi dei principali orientamenti dottrinali e giurisprudenziali relativi all’elemento soggettivo dell’illecito contravvenzionale e all’istituto del caso fortuito, per poi esaminarne l’applicazione in relazione alla casistica in materia di contravvenzioni ambientali. Il contributo evidenzia come l’inquadramento sistematico dell’istituto del caso fortuito e gli orientamenti giurisprudenziali in materia di accertamento della colpa penale possano comportare, in concreto, la sussistenza di tensioni con il principio di colpevolezza.
