Abstract

Riscontrato il multiculturalismo delle nostre società, occorre tanto evitare che il meccanismo pr ssuale presupponga per il giudice o per le parti l’accoglimento di una particolare teoria epistemologica quanto garantire che l’appartenente a una minoranza culturale sia giudicato da un soggetto idoneo a capire il significato della condotta ascrittagli e posto nella condizione di intervenire nella dialettica processuale. Il primo obiettivo è raggiungibile riconoscendo che la concezione semantica della verità è la più adeguata alla ricostruzione giudiziale del fatto. Il secondo si ottiene prescrivendo la naturalità del giudice intesa come sua predisposizione a comprendere i valori socio-culturali coinvolti dal processo e salvaguardando il diritto a un interprete per l’accusato che non comprenda la lingua usata nel procedimento
