Abstract

-------------------------------------------------------------------This thesis will focus on the revision of traditional definitions of the family because this institution is continually submitted to incessant changes. It will defend homosexual people, in the same way as heterosexual people, they are suitable to constitute families where maternity and paternity functions can be performed. In consequence, they can not be invalidated for children adoption without any other reason other than their sexual preferences. It will be necessary to analyse each case individually with the only objective is to differentiate people, their functions and their deep motivation of wanting to have a child. In single-parent families, a crucial point is brought up, if in the woman’s unconscious desire exists a third person as the mother is taking a decision of having a child, or it could be a mother who wants to have a child alone without any male involvement, or support from anybody else.

En esta tesis se plantea realizar una revisión de las definiciones tradicionales de familia debido a incesantes transformaciones a las que se está viendo sometida la institución familiar. La hipótesis de partida es que en el seno de las familias de un solo padre y de padres homosexuales es posible que se den dos elementos fundamentales de cualquier organización familiar: el desempeño de las funciones tanto maternas como paternas, y que se lleven a cabo los procesos de identificación de los hijos. Por tanto, los homosexuales no deberían quedar, de entrada, invalidados a la hora de la adopción de un niño sino que habría que examinar cada caso en particular con el objetivo de intentar discriminar a aquellas personas que puedan cumplir adecuadamente sus funciones y, por otra parte, las motivaciones profundas por las que desean tener un hijo.
