La duda razonable como estándar de prueba en el proceso penal: fundamentos, alcances y límites

Abstract

La transición al sistema procesal penal acusatorio y oral en México ha transformado profundamente el papel del juzgador. En este marco, los principios de presunción de inocencia (artículo 20, apartado B, fracción I, de la Constitución Política de los Estados Unidos Mexicanos) y duda razonable (artículos 13, 359 y 402 del Código Nacional de Procedimientos Penales) se erigen como garantías constitucionales esenciales que limitan el poder punitivo del Estado. Este trabajo se propone examinar la institución procesal de la duda razonable. Su análisis se desarrolla a partir de fuentes doctrinales nacionales e internacionales y de interpretaciones jurisprudenciales, con el objetivo de delinear los criterios que deben regir la motivación judicial en el marco del sistema acusatorio.
